Governor Signs Fire Safety Law

After having passed the senate and house with no nays, HB2434 has been signed by Governor Rod R. Blagojevich becoming Public Act 95-0832 which becomes effective on January 1, 2009. This is great news for residents of manufactured/mobile home communities throughout Illinois.

Manufactured community owner operators are required to have an agreement with the local fire department to provide an adequate and reliable water supply for fire needs. If the community does not have fire hydrants, the fire department needs to know that they are to bring water. Many manufactured community owner operators are not communicating with their local fire departments and often the fire department is unaware that there is a water problem until they pull up to the fire. Before Public Act 95-0832, there was nothing in the Mobile Home Landlord and Tenants Act that spelled out what would happen to a community owner operator if the local fire department had not been contacted.

Public Act 95-0832 requires an agreement between the community owner operator and the local fire chief to be signed by both parties. It also required both the community owner operator or his designee and the local fire chief or his designee to certify – on the application for a community license with the Illinois Department of Public Health – that this agreement exists and a copy must be posted in public view.
