SB 2146

This legislation would allow manufactured homeowners to become involved and offer an avenue if interested in buying the community when the community is being sold by the landlord. Legislation such as this has been passed in other states that recognize the benefits this can bring. These states include: CT, DE, FL, MA, MN, NJ, RI, VT, NH, NJ, OR.
- Manufactured home communities provide a significant source of homeowner opportunities.
Many residents are seniors and low income families. These communities need to be preserved allowing for affordable housing needs.
- With closures and land being sold for other uses, whole communities are displaced with families losing their home and built up assets because the home can not be sold and/or the cost of moving the home.
- This is a more economical alternative then forcing families who are displaced to abandon their homes.
- The only requirement a landlord has in place is to give a 12 month notice when closing the community. Homeowners are led to believe that they will be able to reside in these communities as long as they wish or need to: Especially in senior only communities.
Currently, when a landlord has a community up for sale, homeowners are not notified. This legislation would provide:
- A 60 day notice to the homeowners and homeowner's association that the community is for sale.
- Price, terms, and conditions for which the landlord intends to sell, which is customarily provided to potential commercial buyers.
- Consider any offer to purchase the community from homeowners or the homeowner's association and negotiate in good faith should an offer be made during the notice time.
- There are exceptions to the notice such as if the community is being sold to a family member, partner or partners.
SB 2146 provides that the landlord must continue to maintain the community until the sale. Many times when a community is up for sale, the landlord will not continue to follow through with his/her responsibilities.
Note: There are many for- profit and non-profit organizations whose goals are to educate homeowners regarding this process and will continue working with homeowners that would purchase a community.
